An Edo state High court sitting in Ekpoma, presided over by Honourable Justice Joy Okeaya-lnneh has restrained the Edo state chapter of the Peoples Democratic Party, PDP, from conducting the Local government area congresses scheduled to hold on Saturday, 8th February across the state.
The restraining order in suit No. HEK/9/2020 was filed by PDP members which include a former member of Edo state House of Assembly, representing Etsako West 2 constituency, Hon Eruanga Gallant, Victor Idiakheoa and Jide Obalowoshe.
The interim injunction also includes an order retraining the PDP and INEC from announcing, publishing and recognising the ward congresses results earlier conducted by the party.
While granting the order after hearing from Osehimime Osemede, learned counsel to the plaintiffs, Justice Okeaya-Inneh ordered: “I have carefully considered the Motion Exparte before Court together with the Affidavit in Support and Affidavit of Urgency with the attached Exhibits A, A1, B, B1, B2, D and E and Written Address of Counsel for the 3 Applicants in this motion.
“I find that the Applicants have satisfied the guidelines for the grant of the order sought as enjoined in the landmark case of KOTOYE V CBN (1989) 1 NWLR (PT. 98) 419 at 441.
The case was adjourned to 24th of February for hearing.
